Berks Construction, Co., Inc. Berks uses the information provided by you in order to service your account or transaction.  Berks is a full service real estate company that (through it or its affiliates or other third parties) provides services for your new home purchase.  Set forth below in (a)-(d) is the policy of Berks with regards to sharing or disclosing your information to other companies, including affiliates and non-affiliates.

 


a) Affiliates Companies:
  Your information may be disclosed to affiliates of Berks including, but not limited to Berks Real Estate Services, LLC, Berks Mortgage Services, LLC and Freedom Settlement Company, LLC in order to complete your transaction. It may also be disclosed to affiliates companies to allow the affiliates companies to market products and services that are not required to complete your transaction.  There are no opt out rights available for these types of disclosures.

b) Non-Affiliated Third Party Companies – no opt out rights:   Berks may also disclose your information to non-affiliated third parties as is required to complete your transaction.  In such a case, these non-affiliated third parties will receive only the information necessary to perform support services to Berks for your transaction.   

Berks may also disclose your information to non-affiliates third parties to perform services or functions on behalf of Berks, including marketing of Berks’ own products or services or financial products and services offered pursuant to joint agreements between Berks and other financial institutions.  However, in any such agreement with another financial institution, Berks shall require that the other financial institution maintain the confidentiality of such information.

There is no right to opt-out of these types of disclosures.

c) Non-Affiliated Third Party Companies –  opt out rights available:  Berks may disclose your information to non-affiliated third party companies who may market their services to you.  Specifically, Berks may provide your information to companies who market products that Berks feels might provide valuable services for your transaction or products and services that could be beneficial to you.  You may advise us that you do not wish us to make disclosures to non-affiliated third parties other than as is required to complete your transaction.  To do so, fill out the “Opt-Out” form at the bottom of this notice and return it as set forth below or call us at the number listed below.

d) Disclosures Required by Law – no opt out rights: There are also situations where disclosure of your information to a third party is required by law.  Such instances could include (but are not limited to) reports filed with certain government agencies or documents produced in response to a court order or subpoena.  There is no right to opt-out of this type of disclosure.


2. Your Rights Remain Even After You Cease to be a Customer

Berks values our relationship with our customers and also with our former customers.  All privacy policies and procedures which cover our current customers are also extended to our former customers.  Rest assured that your information is protected with Berks.

3. Collected Information

The information collected by Berks will only be that which is necessary to facilitate the transaction which you selected Berks to complete.  That information includes your name, mailing address, telephone numbers, email address, financial preference and any other demographic, financial or property information provided to Berks on forms either in print, on our website, or given in person to Berks.  This could also include information provided to Berks from outside reporting agencies, such as a credit bureau, or provided by our affiliates.

4. Protecting Your Personal Information

Berks maintains physical, electronic and procedural safeguards which comply with federal standards to safeguard your personal and financial information.  We employ policies and procedures to ensure the physical safety of your records and workplaces.  Our employees are required to abide by a strict confidentiality policy.  Also, employees of Berks are only privy to information necessary to complete your transaction.  Each affiliate or third party involved in your transaction is required to uphold strict privacy standards.  We also use technological safeguards such as virus detection, file back-ups, firewalls, and other software and hardware to protect against unauthorized alteration or access to your information electronically.
